Returns
Refund of money for a Product of proper quality. 1. Only the Buyer or a person authorized by the Buyer has the right to receive funds for the returned Product. 2. If a refund is requested by a person who received the Product as a gift and wishes to return it, such person has the right to do so in the manner defined in this section as if the Buyer were doing so. For this, it is necessary to provide an identity document by any method and in any form provided by these Terms (by email). 3. If the returned Product meets all necessary requirements, the Seller will use all efforts to return the amount paid under the retail sale contract, excluding delivery expenses, within ten (10) days from the date the consumer submits the relevant request. Exchange of a Product of proper quality. 1. The Buyer has the right to return a Product purchased through the Website for exchange for another Product placed on the Website, provided that the return of the Product complies with these Return Terms. 2. In any case, the sale of the returned Product will be canceled and a new Order for the Product must be placed. 3. If the Product is returned for exchange for a more expensive Product, the Buyer must pay the price difference. 4. If the Product is returned for exchange for a less expensive Product, only the Buyer of the returned Product or a person authorized by the Buyer will be able to receive funds in the amount of the price difference. 5. Upon receipt of the Product, the Seller conducts a commission inspection to verify the Product's authenticity and to identify any possible product substitution. 5.1 The Buyer is informed that in the event of product substitution, the Buyer bears liability under Articles 158 and 159 of the Criminal Code of the Russian Federation. 6. Please note that a return is possible only if the item is in perfect condition and has no signs of wear or use. The Seller does not accept a return if the item shows signs of wear or use. Return or exchange of a Product of improper quality. 9.7.1. If the Buyer discovers manufacturing defects in the Product, the Buyer must immediately notify this by phone indicated on the Website and follow further recommendations. 9.7.2. The Buyer will be offered to send the Product for diagnostics by any method specified in these rules. 9.7.3. If diagnostics confirm the presence of manufacturing defects, the Buyer has the right to make the relevant claim provided by consumer protection law. 9.7.4. If diagnostics confirm the absence of manufacturing defects, the Buyer will be asked to pick up the Product personally or arrange its delivery at the Buyer's expense. PERSONALIZED PRODUCTS 1. When selecting Products, personalized Products (for example, Products with engraving or embossing) may be available if such products are offered on the website. 2. The Seller has the right to refuse to accept or to suspend an Order containing a personalized Product or a personalized card if the text contained in the Order is undesirable, illegal, or contrary to the Seller's policy. The Buyer is responsible for the correctness of the wording provided for personalization of Products. 3. Orders for personalized Products cannot be canceled, and Products that were personalized in any form or otherwise created in accordance with the Buyer's instructions cannot be returned for exchange or refund. This does not affect the Buyer's rights as a consumer (for more details, return to the section "Manufacturer's warranties and rights of the Buyer (consumer)" in these Terms). SELLER'S LIABILITY 1. To the extent permitted by applicable law, the Seller excludes and disclaims all other conditions and warranties with respect to Products, whether expressly stated or implied by law or otherwise, or arising from prior business practice or trade practice. 2. Nothing in these Terms limits or excludes the Seller's liability that cannot be limited or excluded in accordance with applicable law. Subject to the previous sentence and the statutory rights of the Buyer, the Seller's aggregate liability to the Buyer under these Terms for any Order, whether under the retail sale contract or in tort, or other liability, even if the Seller was informed of the possibility of damage to the Buyer, shall not exceed one hundred percent (100%) of the price of the Product(s) in the Order. 3. The Seller is not liable for any failure and/or delay in performance of its obligation under these Terms if such failure and/or delay occurred due to reasons beyond the Seller's reasonable control. 4. The Buyer is hereby warned that in some jurisdictions, consumer protection laws may not allow certain exclusions or limitations of warranties or liability, and therefore some of the above exclusions or limitations may not apply.
RETURN AND EXCHANGE OF PRODUCT Right to return a Product of proper quality. 1. The Buyer has the right to return a Product of proper quality without giving reasons at any time before it is transferred to the Buyer and within seven (7) days from the day when the recipient of the Order specified in the Order Confirmation became the actual owner of the Product in the Order. 2. To return the Product, the Buyer needs to contact the contacts posted on the website and obtain further instructions. Contact details are provided in the "Contact Us" section. 3. Return of Products that are jewelry of proper quality is possible if - its appearance is preserved; - its consumer properties are preserved; - a document confirming the fact and conditions of purchase of the specified product from the Seller is provided (unless otherwise expressly provided in this clause); - the consumer packaging of the Product is preserved and provided. If the Consumer does not have a document confirming the fact and conditions of purchase of the Product, the Consumer must provide the Seller with other evidence of purchase of such Product from the Seller. Process of return of a Product of proper quality. 1. To return a Product, the Buyer must follow the instructions below: The Buyer may: - choose an address for sending the parcel among the provided addresses of the Authorized Carrier within the required return period. For this, the Buyer must contact the seller. At this stage the Buyer may be asked to provide information about the Product for an initial assessment of its condition; - an email will be sent to the Buyer with a return form that must be completed and signed; - in the parcel for shipment the Buyer must include the completed form together with the Product, all its accessories, any items received free of charge as part of the Order, the service manual, the warranty card, and all other documents in their original packaging; - the Buyer must hand the parcel to the Authorized Carrier or bring the parcel on the day and to the address of the Authorized Carrier, acting in accordance with the return conditions. 2. Refund of funds paid under the retail sale contract is carried out only in respect of those Products that are returned in accordance with the above procedure. 3. In order to minimize the risks of possible fraudulent actions when returning a Product by a person who did not purchase the Product directly from the Seller, the Seller or a person authorized by the Seller has the right, before issuing a refund, to contact the Buyer who purchased the Product from the Seller in order to establish the circumstances of the transfer of the Product to such person. 4. Refunds are made minus the cost of delivery, which does not contradict paragraph 4 of Article 26.1 of the Law of the Russian Federation on Protection of Consumer Rights. Condition of the returned Product of proper quality. 1. The Seller first has the right to make sure that the returned Product meets all requirements for this category of Product in accordance with the law and these Terms, and only after that does the Seller have the right to proceed with the refund. 2. Return of a Product is possible if it is returned new and unused, in perfect condition, with all protective materials (tags and labels) attached to the Product (if applicable), and together with the original box and shipping package, including all its accessories and documents. The Seller has the right not to accept any return if the Product shows signs of wear, or has been used, or has been altered in any way from its original condition, or, alternatively, the Seller has the right to reduce the refund amount. 3. If the Buyer received free items as part of the Order, such items must be returned together with the Products. 4. All returns are subject to strict quality control to ensure that the returned Products meet all requirements. If the Products do not meet quality control standards, the Seller has the right to refuse a refund; in this case the Seller returns the Product to the Buyer. If the returned Product meets quality control standards, the Seller proceeds with the refund. 5. Failure to comply with these Terms gives the Seller the right to refuse the returned Product and send it back to the Buyer at the Buyer's expense. Products of proper quality that the Buyer cannot return. 1. Orders for Products that were personalized in any way (including Products with engraving or embossing or made to unique characteristics for the Buyer) or otherwise created in accordance with the Buyer's instructions, that is, having individually determined properties, cannot be canceled, and the Buyer cannot return such Products.
